Can someone else be the power of attorney over my husband?

Can someone else become the power of attorney over my husband? We have been separate for a little over a year. I know he has a girlfriend and has recently gotten himself into a bit of trouble with the law. She is alot younger than him and I think he is going thru a mid life crisis lol. Do I still have rights over him (ie:Power of Attorney)? Please let me know thanks. Real answers please.Can someone else be the power of attorney over my husband?

Ok to the first part of your question, yes other than the spouse can be power of attorney, and its certainly NOT automatic that a separated spouse would have that responsibility/control.


The power of attorney has to be applied for, and is only allowed in strict circumstances.


But why would you want to become responsible for him if he's already moved on with someone else? The power of attorney HAS to be used in that person's best interest, so you couldn't use it for your own reasons (revenge/pay back/balancing the accounts, etc.), without facing the possibility of criminal charges - fraud, etc. It is that serious.


I'd check with a local legal aid group, Law school, or similar, or your own lawyer before attempting to gain that P. O. A.
Anybody that your husband appoints can be. Its his choice. At all times, whether you are married or not.





2 different kinds.. standard POA... appointed for particular reason,or period of time, like buying selling a property, or whilst the Donor is out of the country. Or Enduring... EPA...ongoing, commences at appointed time.. immediately... or when Donor becomes incapacitated, until Death or is revoked by Donor.
