Can my ex husband and i both claim daycare expenses for our son?

We have two boys and I claim one and he claims the other. I have been claiming my younger son and his daycare expenses. My ex just asked the daycare for a tax receipt. He told me he puts both sons on his taxes and marks one non-dependant but still puts the daycare expense for him. Can he do that? I thought only one of us can claim it, and that would be me. First, who pays for the daycare expenses? Only the person who pays can take the credit.





Second, who does the younger son live with the most? Only the custodial parent can claim the credit. The custodial parent does not have to claim the child as a dependent to take the credit.





If you (or your ex-spouse) are the custodial parent and pay for the daycare expenses, then you can take the credit. Otherwise, you can't.
You paid it, you get it. He better not claim it also or the feds will come calling. What does the divorce settlement say about claiming the kids? Who do the kids live with? Remember, child support is not taxable to you/deductible to him - only spousal support.

Child Care is totally deductible up to a particular dollar amount. I am not certain what it is this year but I believe in the 3-6 k range.

Just by the information you provided, you both can not claim day care expenses on the same child. Your ex can list alimony paid on his return to reduce his income. You would claim the day care expenses.

If you havw two boys, then you claim claim one boy as a dependent on your tax return and your ex husband can claim the other boy as a dependent on his tax return. But child care epxneses are not deductible.
